for Reading with Ms. Kristy, LLC

These Terms of Service (“Terms”) govern your use of the website and tutoring services provided by Reading with Ms. Kristy, LLC (“we,” “us,” or “our”), operated by Kristina Benitez. By booking our services or using our website, you agree to these Terms.

Please read these Terms carefully before booking a consultation or enrolling in our services. If you do not agree with these Terms, please do not use our services.

1. Services

Reading with Ms. Kristy, LLC provides private tutoring services to students in K - 5 Reading and Literacy. Our services include:

• Initial consultation calls to assess student needs and determine fit

• Individualized tutoring sessions conducted online

• Progress monitoring and parent communication

• Written progress reports as described in your enrollment agreement

NOT A CLINICAL OR DIAGNOSTIC SERVICE

Our tutoring services are educational in nature. We are not a licensed clinical, therapeutic, or medical provider. We do not diagnose learning disabilities, conduct psychoeducational evaluations, or provide speech-language therapy, occupational therapy, or any other licensed clinical service. If you have concerns about your child’s development, learning, or mental health, we encourage you to consult with a qualified licensed professional.

2. Consultation Calls

We offer a complimentary consultation call for prospective families. This call is an opportunity for both parties to assess whether our services are a good fit. Scheduling a consultation does not constitute enrollment or create any obligation on either party.

We reserve the right to decline to provide services to any prospective client at our sole discretion.

3. Enrollment and Service Agreements

Enrollment in our tutoring services is formalized through a separate service agreement (contract) that you will be asked to review and sign. That agreement governs the specific terms of your engagement, including:

• Session frequency and duration

• Payment terms and rates

• Cancellation and rescheduling policies

• Program length and structure

These Terms of Service govern your general use of our website and services and should be read together with your service agreement.

4. Payments

Payment terms for tutoring services are set forth in your individual service agreement. We use Honeybook to process payments securely. We do not store your full payment card information.

All fees are in U.S. dollars unless otherwise specified. Fees are non-refundable except as expressly stated in your service agreement.

5. Results and No Guarantees

We are committed to providing high-quality, individualized tutoring services. However, we cannot guarantee specific academic outcomes or results. Student progress depends on many factors including, but not limited to, the student’s attendance, engagement, home practice, and individual learning profile.

Testimonials or examples of student progress shared on our website or marketing materials reflect individual experiences and are not a guarantee of similar results for every student.

6. Intellectual Property

All content on our website, including text, graphics, logos, and educational materials we create, is the property of Reading with Ms. Kristy, LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without our express written permission. Materials provided to your child for educational purposes are for personal, non-commercial use only.

7. Confidentiality

We treat all information shared about your child with respect and confidentiality. We do not share student information with third parties except as described in our Privacy Policy or as required by law.

We ask that families likewise treat session content, materials, and any information shared by our practice with discretion.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW,

READING WITH MS. KRISTY, LLC, ITS OWNER, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) ]MONTHS PRIOR TO THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Reading with Ms. Kristy, LLC, its owner, and representatives from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of our services, your violation of these Terms, or your violation of any third party’s rights.

10. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Bexar County in Texas.

11. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the effective date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
